The Executor's Office

Subrogation
The trust steps into the shoes of the original party (the registered owner), allowing it to enforce the settlement and pursue claims against fraud or misclassification without requiring privity.
Usufruct Rights
Grants beneficial use of settlement proceeds and assets to the Named Party while preserving legal title in the trust — a recognized structure under New York estates law for life interests and beneficial ownership.
Nunc Pro Tunc
Retroactive correction of clerical or recording errors — such as misclassifying a living infant as a decedent — validated under SCPA procedures to restore the Named Party's legal capacity as of the original date.
Executor's Authority & Duties
Marshal Assets
The Executor is duty-bound to identify, collect, and secure all assets belonging to the estate or settlement — including unclaimed securities and financial instruments that remain undistributed.
Defend Title
Assert and protect the Named Party's equitable and legal title against any challenge, using the Registrar's own seal and filing as conclusive, self-authenticating evidence of probate.
Perfect the Record
Demand Registrar annotation of nunc pro tunc restoration, confirming Named Party's perfected title under UTC §401 and UCC §9-312 financing statement perfection.
Distribute Per Settlement
Execute the settlement memorial's terms by assigning usufruct, equities, and beneficial interests to the living trust beneficiaries and filing necessary UCC amendments.
